Honourable Nigel Carty

Prime Minister Dr. Denzil Douglas outside his Government Headquarters on Church Street Basseterre with his all his candidates for the upcoming general elections slated for February, 16th 2015

At the start of this saga, I pointed out that I have no confidence in some practitioners of our judiciary. The appeals court has proved me right. I wish to point out a few facts, the Chief Justice is married into the family of the Perieras, the Perieras family are founding members of PAM, PAM is a part of this appeal which was hastily heard by the Court of Appeal. The President of the CCJ is Dennis Byron. His Brother Vincent Byron is a part of the legal team and advocate for the decision that was delivered.

Consider these facts. I can't help but wonder if they are coincidental. I contend that our justice is not on sale to friends of the Periras and Byron Law. The real travesty is that the appeal court seem to want to rewrite our constitution and legislate for the people of St. Kitts and Nevis or worse decide who should govern St. Kitts non of which is bestowed on that institution.

Contesting the result of an election is an avenue available to anyone who isn't satisfied with the outcome. A court intervening in the contesting of or the delaying of an election is unheard of in jurisprudence. Such intervention can influence the outcome of the way voters vote and certainly that is not the function of any court. I recall however this appeal court behaving the same way in the election petition in Nevis tarnishing the name of persons who wasn't named in the original motion by and did not present evidence in there defence should have been found guilty and imposed cost damaging there chances of being elected but later altered itself.

That court also waited until two days before, and the elections negating the possibility of objection hearings, most if not all of those names have since been successfully objected to and removed. What is strikingly alarming is that the players involved in the litigation directly and indirectly are the same and the decisions of the court on both occassions favoured the same litigants. Is this coincidental or a pattern?

I will not stand by and allow our justice to be sold to friends of the Perieras and Byron Law. A few things to note that the opposition up to now made no changes to their campaign signs for candidates . Is it because they new that the court of appeal would have extraordinarily and what the decision would be? Again I ask is this coincidental?

I call on all who stand in defence of our justice to join with me in doing two things. 1. To sign a petition expressing our lack of confidence in the COURT  OF  APPEAL in delivering impartial decisions in political matters in St. Kitts and Nevis and interfering in our political process thereby denying the people their right to elect a government of their choice. 2. Filing 1000 injunction against the supervisor of election preventing him from supervising election on any other boundaries other than those proclaimed on January 16. The time for action is NOW.

This is the UNEDITED  STATEMENT  OF  THE  HONOURABLE  NIGEL  CARTY  POSTED  ON  FACEBOOK (but now seemingly removed).

Are these the Cabinet views of The Prime Minister Dr. Denzil Douglas Administration?
