Brother Khrystus' SEDITION Case brought against him by The Right Honourable Dr. Denzil L. Douglas St. Kitts - Nevis Labour Party Administration has been adjourned again - multiple times since Monday, 27th May, 2013 all in an ongoing effort to keep the young man highly frustrated and to possibly send him crazy.
The reason?
The Dr. C.G. Walwyn Royal St. Christopher and Nevis Police Force was still not ready.
The sitting magistrate had adjourned the case from Monday, 12th January, 2015 to today Monday, 2nd February, 2015 to give the Royal St. Christopher and Nevis Police Force enough time to prepare and present the evidence that they have been collecting from since Brother Khrystus' arrest and incarceration for some six (6) months on Monday, 27th May, 2013 on politically motivated SEDITION CHARGES.
When Magistrate Mallelieu asked for an update to begin the case, the representative from The Director of Public Prosecution's Office quickly pulled himself out stating that their office, up to today, was yet to receive a file on Brother Khrystus' Sedition Case from the Royal St. Christopher and Nevis Police Force.
Sergeant Morton of The Criminal Investigation Division headed by Superintendent Charles Smithen then took the stand.
Magistrate Mallielieu asked Morton for an update and asked him to report on Brother Khrystus' computers still in police custody, after Superintendent Charles Smithen, Head of The Criminal Investigation Division promised to return ALL but one by Wednesday, 29th October, 2014.
CID Morton, who was the one responsible for returning the computers to the young Wallace, told the learned Magistrate that the police returned some of the computers but were still searching the balance of the computers for evidence. This greatly contradicted Superintendent Charles Smithen's statement made at The Basseterre Magistrate Court before Her Worship Josephine Mallelieu when he stated on Monday, 27th October, 2014 that his department would return ALL but one of Brother Khrystus' items/computers that were taken on Monday, 27th May, 2013. On that same day in October, Smithen had told the court that he would be travelling OVERSEAS and the sitting Magistrate adjourned Brother Khrystus' case to January, 12th 2015.
The big question is. Who is lying? Sergeant Morton or Superintendent Smithen? Where are Brother Khrystus' computers? Were they stolen? Are they missing? Are they working? The Royal St. Christopher and Nevis Police Force told the court on Monday, 27th October, 2014 that they would RETURN ALL BUT ONE. They only returned 1/3 of KVK ENTERPRISES - www.kvklives.com and The Wallace Family items that they took on the raid they executed on the premises without a COURT ORDER OR SEARCH WARRANT.
All throughout the entire court morning, head of Brother Khrystus' Blazing Star Movement - www.theblazingstarmovement.com, KVK ENTERPRISES - www.kvklives.com and Dare 2 Be Different International - www.daretobedifferentskn.com legal team, Sir Nassibou Butler, who has been practicing law in The Federation of St. Kitts and Nevis for most of his life and who was The Director of Public Prosecution under The People's Action Movement Dr. Kennedy Simmonds Administration, could be seen smiling and just taking notes and objecting to nothing being said.
Brother Khrystus' Sedition Case continues tomorrow Tuesday, 3rd February, 2015 and this time, Magistrate Mallelieu has summoned head of The Royal St. Christopher and Nevis Police Criminal Investigation Division, Superintendent Charles Smithen to give his report / statement.
Over the weekend, Brother Khrystus, Lawyer Nassibou Butler, a Caribbean and USA Lawyer were on conference call discussing strategies to deal with Wallace's Sedition Case which now seems to be making HISTORY across The Federation of St. Kitts and Nevis, The Caribbean Region and The World as The Federal Government tries to do all in its power to crush the young man's Radical Blazing Star Movement Political Party - www.theblazingstarmovement.com and possibly destroy the young man and scare him away from POLITICS.
When Justice Ramdhani released Brother Khrystus on bail on a mere EC$5000 / US$1872 on Friday, 29th November, 2013 after he had already served six (6) months in prison when all previous magistrates and judges had denied him bail, Justice Ramdhani was quick to state OUTRIGHT that he saw NOTHING SEDITIOUS in Wallace's article and was shocked that he had served some SIX (6) months in a St. Kitts - Nevis jail JUST FOR WRITING A COMICAL ARTICLE.
Even after Ramdhani's statements, the Royal St. Christopher and Nevis Police Force is still doing all in their power to push the charges.
The big question is. Who is really behind pushing the charges?
Brother Khrystus' USA LEGAL TEAM advising on the matter, months ago commented,
It is imperative that we share a paragraph from a book titled THE ENLIGHTENMENT - 1687 - 1776 (Volume II of A HISTORY OF MODERN CULTURE by CRANE BRINTON) that addresses Seditious Publications.
The practice of the British American colonies varied. On the whole liberty of speech enlarged its bounds in all the colonies. The chief battle was fought in New York, when John Peter Zenger founded the New York Weekly Journal in 1733 and filled the early numbers with articles censuring the government. Arrested and sent to prison for these on a warrant of the governor and council (1734), he was tried by a jury that boldly asserted its right to judge both the law and the facts, that repudiated the old maxim "the greater the truth, the greater the libel." and that triumphantly acquitted Zenger of the charge of SEDITIOUS LIBEL. This meant complete liberty of the press thereafter in NEW YORK. It was rightly hailed as "THE DAWN OF THAT LIBERTY WHICH AFTERWARDS REVOLUTIONIZED AMERICA." END
Word on the streets of St. Kitts and Nevis is that Brother Khrystus would come off a multi-millionaire because it is a fact that The Federal Government of St. Kitts and Nevis has no case, but is just buying time for one reason or the other. JUSTICE DELAYED IS JUSTICE DENIED!
Probably, Prime Minister Dr. Denzil Douglas would hate to see local, regional and international headlines READ 28 Year Old Politician Beats Prime Minister Dr. Denzil Douglas Administration In Court - WHAT A VICTORY!
